New Wave is an Australian coastal clothing brand based on the Central Coast of New South Wales. These terms apply to your use of this website and to any order you place with us.

By using this website you agree to these terms. If you don't agree with them, please don't use the website.

To place an order you must be able to enter a legally binding contract. If you're under 18, please order with the involvement of a parent or guardian.

We describe our products as accurately as we can, including fabric, construction, fit and measurements, based on our approved product specifications. If a description is unclear or appears wrong, ask us before ordering.

We photograph our products as faithfully as possible. Colours can appear slightly differently between screens and devices, so images are a guide rather than an exact match.

Stock is limited and availability can change while you're shopping. If an item you've ordered isn't available, we'll contact you and offer a replacement where you want one, or refund that item.

Prices are displayed in Australian dollars. Prices for Australian orders include GST where GST applies. Shipping costs, where they apply, are shown separately at checkout before you pay.

Very occasionally a price may be displayed incorrectly. If we identify an obvious pricing error before your order is dispatched, we'll contact you to confirm whether you'd like to continue at the correct price or cancel the order for a full refund. We won't simply charge you more without your agreement.

When you place an order you'll receive a confirmation email acknowledging that we've received it. Please check it and let us know straight away if anything is wrong.

A contract is formed when we accept your order, which we do by dispatching it. Where we can't accept an order — for example because the item is unavailable, there was an obvious pricing error, or we can't verify payment or the delivery address — we'll tell you why and refund any amount you've paid for that item.

You can ask us to cancel an order before it's dispatched and we'll do so where we're able to. We only cancel orders ourselves for the reasons set out above, and we'll always refund you in full when we do.

Payments are handled by third-party payment providers. You agree to their terms when you pay. We don't store your full card details.

Promotions, discount codes and offers may have their own conditions, such as an end date, minimum spend or excluded products. Those conditions are shown with the offer. Unless stated otherwise, offers can't be combined and can't be applied retrospectively.

Shipping options, costs and estimated delivery timeframes are shown at checkout and explained on our shipping page. Delivery timeframes are estimates provided by our carriers, not guarantees.

Our returns policy forms part of these terms. It sets out our voluntary change-of-mind policy, which is offered in addition to — and does not limit — your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms or any New Wave policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

The New Wave name, logo, artwork, designs, photography and website content are owned by New Wave or used with permission. Please don't reproduce, resell or use them commercially without our written permission.

Please don't interfere with the website's operation or security, attempt to access it in an unauthorised way, scrape it at scale, or use it for anything unlawful.

The website uses and links to third-party services, including payment, delivery and analytics providers. Those services have their own terms and privacy practices, which we don't control.

We aim to keep the website available and up to date, but it may occasionally be unavailable for maintenance or reasons outside our control.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. Subject to that, our liability to you is limited to the remedies available under the Australian Consumer Law and, where the law allows us to limit it, to resupplying the product or refunding what you paid for it.

These terms are governed by the laws applying in Australia, and by the Australian Consumer Law.

We may update these terms from time to time. The terms that apply to your order are the ones published when you placed it.

If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
